These Terms and Conditions ('Terms') govern your use of the Smart Brain Health Centre website at smartbrainhealthcentre.com.au and the purchase and use of all products and services offered by Smart Brain Health Centre (operated by Louise Hallinan, referred to as 'we', 'us', or 'our').
By accessing our website, purchasing a product or service, or joining our membership, you agree to be bound by these Terms. Please read them carefully. If you do not agree with any part of these Terms, please do not use our website or services.
1. About Us
Smart Brain Health Centre is operated by Louise Hallinan, a qualified Nutritionist and Natural Medicine Practitioner, ABN: 14 385 018 559, based in Heddon Greta, NSW, Australia. Louise Hallinan is a registered member of ATMS and AHA and practises in accordance with those professional bodies' codes of conduct.
2. Important Health Disclaimer
The information, content, products, and services provided by Smart Brain Health Centre are intended for educational and informational purposes and as a complement to — not a replacement for — professional medical care.
Nothing on this website, in our programs, courses, membership content, book, assessment, or consultations constitutes medical advice, diagnosis, or treatment. Always consult a qualified medical professional before making changes to your health, medication, or lifestyle.
Specifically:
The Healthy Brain Assessment is an educational screening tool. It does not diagnose any medical condition and should not be treated as a clinical assessment or medical opinion.
The Healthy Brain Blueprint course, Healthy Brain Momentum membership content, and all written materials are educational in nature and do not constitute personalised health advice unless explicitly provided through a direct consultation.
The Smart Brain Prevention Program involves personalised natural medicine and nutritional guidance. This is complementary healthcare and does not replace the advice of your treating medical practitioner.

3. Products and Services
3.1 Smart Brain Healthy Brain — Book
The book ‘Smart Brain Healthy Brain’ is available for purchase directly from our website. Orders are dispatched within 3 business days. We are not responsible for delays caused by Australia Post or other delivery services. All books are signed by Louise Hallinan and posted with complimentary Australian postage.
3.2 Healthy Brain Assessment
The Healthy Brain Assessment is provided free of charge as an educational tool. Results are generated by an automated scoring process and are provided for informational purposes only. By completing the Assessment, you consent to receiving follow-up email communications based on your results. You may unsubscribe at any time.
3.3 Healthy Brain Blueprint — Online Course
Upon purchase of the Healthy Brain Blueprint, you will receive access to the course content for your personal, non-commercial use. You may not share, reproduce, resell, or distribute course materials. Access is provided to a single user and is non-transferable.
3.4 Healthy Brain Momentum — Membership
Healthy Brain Momentum is a subscription Membership available in three tiers — Clarity ($39/month), Vitality ($89/month), and Longevity ($149/month) — or on annual billing. By joining the membership you agree that:
Your membership will automatically renew each month (or year for annual memberships) until cancelled
You may cancel your monthly membership at any time — cancellation takes effect at the end of your current billing period
Annual memberships are non-refundable once the billing period has commenced
Membership content is for your personal, non-commercial use only and may not be shared or distributed
We reserve the right to modify membership inclusions, pricing, and tier structures with reasonable notice to members
3.5 Smart Brain Prevention Program — 1:1 Consulting
The Smart Brain Prevention Program is a personalised 6-month Consulting program. Participation is subject to an application and acceptance process. By entering the program, you agree to:
Pay the program investment of $3,500 in full, or $650 per month over 6 months
Attend scheduled consultations or provide a minimum of 24 hours' notice of cancellation
Provide accurate and complete health information to enable appropriate care
Understand that natural medicine and nutritional support is complementary healthcare and does not replace medical treatment
Cancellation of the Smart Brain Prevention Program after commencement will be managed on a case-by-case basis at Louise Hallinan's discretion, having regard to the services already delivered.
4. Payments and Pricing
All prices are listed in Australian dollars (AUD) and include GST where applicable. We accept payment via the methods listed at checkout. Payments are processed by our third-party payment provider — we do not store your payment card details.
We reserve the right to change our pricing at any time. Price changes to membership subscriptions will be communicated to existing members with a minimum of 30 days' notice before taking effect.
5. Refund and Cancellation Policy
5.1 Book Orders
If your book arrives damaged or does not arrive within a reasonable timeframe, please contact us at louise@smartbrainhealthcentre.com.au and we will arrange a replacement or refund at our discretion.
5.2 Online Course
Due to the digital nature of the Healthy Brain Blueprint course, we do not offer refunds once you have accessed the course content. If you have purchased the course but have not yet accessed it, please contact us within 7 days of purchase to request a refund.
5.3 Membership
Monthly memberships may be cancelled at any time. No refund is provided for the current billing period. Annual memberships are non-refundable. If you experience a significant issue with your membership access, please contact us and we will work to resolve it promptly.
5.4 Smart Brain Prevention Program
A deposit or first instalment is non-refundable once the program has commenced. For instalment plans, payments for months not yet commenced may be cancelled with 14 days' written notice. This policy is subject to Australian Consumer Law.
5.5 Australian Consumer Law
Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
6. Intellectual Property
All content on our website and in our products — including text, images, videos, audio recordings, worksheets, course materials, membership content, and the book Smart Brain Healthy Brain — is the intellectual property of Louise Hallinan and Smart Brain Health Centre, unless otherwise stated.
You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any of our content without our prior written permission, except for your own personal, non-commercial use.
7. Membership Community Standards
Members of Healthy Brain Momentum who participate in any member community agree to:
Treat all other members and Louise Hallinan with respect and courtesy
Not share, reproduce, or distribute any content from the membership to non-members
Not post promotional content, spam, or unsolicited commercial messages
Not post content that is offensive, defamatory, discriminatory, or harmful
We reserve the right to remove any content that violates these standards and to suspend or terminate membership access for serious or repeated breaches, without refund.
8. Live Sessions — Webinars and Consultations
Live sessions (webinars, group focus sessions, and 1:1 consultations) are conducted via video conferencing. By participating, you agree to:
Not record, share, or distribute session recordings without our express written consent
Understand that sessions may be recorded by Smart Brain Health Centre for member replay purposes (Vitality and Longevity members) and that your participation may be captured in these recordings
Maintain the confidentiality of other participants in group sessions
If you are unable to attend a scheduled 1:1 consultation, please provide at least 24 hours' notice. Missed appointments with less than 24 hours' notice may be forfeited.
9. Limitation of Liability
To the maximum extent permitted by law, Smart Brain Health Centre and Louise Hallinan will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our website, products, or services — including but not limited to loss of income, loss of data, or loss of opportunity.
Our total liability to you for any claim arising from our products or services is limited to the amount you paid for the relevant product or service.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, that cannot lawfully be excluded under the Australian Consumer Law.
10. Website Use
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
Use our website in any way that violates applicable laws or regulations
Transmit unsolicited or unauthorised advertising or promotional material
Attempt to gain unauthorised access to our systems or other users' accounts
Use automated tools to scrape, crawl, or extract content from our website
